The terms that govern your use of Globlo.
1. Who we are
Globlo is a technology marketplace that connects Trip Managers, Service Providers, and Travellers and Photographers for wildlife and photography journeys in India, and facilitates the payments that move between them. By creating an account or otherwise using Globlo, you agree to these Terms & Conditions.
2. What Globlo is, and is not
Globlo provides the platform, discovery tools, and payment infrastructure that connect independent Trip Managers and Service Providers with Travellers. Globlo does not itself operate, guide, own, or curate any trip, tour, safari, or itinerary listed on the platform. Every trip is designed and delivered by an independent Trip Manager, in coordination with independent Service Providers. Globlo is not a party to the trip itself, and is not responsible for its planning, execution, or quality, beyond our role as the marketplace and payments infrastructure connecting the parties involved.
3. Acceptable use
When using Globlo, you agree not to:
- Provide false or misleading information about yourself, your listings, or a booking.
- Use the platform for any unlawful purpose, or in a way that infringes the rights of others.
- Circumvent Globlo's payment system to avoid platform fees or protections, where such protections apply.
- Upload content you do not have the right to share, or that is abusive, harmful, or infringes intellectual property rights.
- Interfere with the normal operation of the platform, including through unauthorized automated access.
4. Accounts and responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep it up to date. Trip Managers and Service Providers are responsible for the accuracy of their listings and for honoring the bookings they accept. Travellers are responsible for reviewing listing details, terms, and any requirements before booking.
5. Payments
Payments made through Globlo are processed by a third-party payment gateway. By making or receiving a payment through the platform, you also agree to the applicable terms of that payment processor. Globlo routes payments between Travellers, Trip Managers, and Service Providers as part of its marketplace function, and may apply a platform fee, which will be disclosed at the relevant point in the booking process.
6. Cancellations and refunds
Cancellation and refund terms may vary by Trip Manager, Service Provider, and listing, and are set out in a separate cancellation and refund policy made available at the time of booking. Please review the specific cancellation terms for a listing before booking.
7. Limitation of liability
To the fullest extent permitted by law, Globlo is not liable for any indirect, incidental, or consequential damages arising from your use of the platform, or from any trip, service, or interaction facilitated through it. Because Globlo does not operate or guide trips itself, we are not liable for the acts, omissions, or performance of any Trip Manager or Service Provider. Our aggregate liability for any claim arising from your use of the platform is limited to the amount of fees paid by you to Globlo in connection with the relevant booking.
8. Intellectual property
Content you upload to Globlo, including photographs and listing materials, remains yours. By uploading content, you grant Globlo a non-exclusive, worldwide license to display and distribute it as part of operating the platform, such as in a listing or the public gallery. You are responsible for ensuring you have the rights to any content you upload.
9. Dispute resolution
If a dispute arises between platform participants, we encourage direct resolution between the parties where possible. Where a dispute involves Globlo directly, we will attempt to resolve it informally first. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of India, as set out in the governing law provision below.
10. Governing law
These Terms & Conditions are governed by the laws of India, without regard to conflict-of-law principles. Any legal action or proceeding relating to your use of Globlo will be brought exclusively in the courts of India.
11. Changes to these terms
We may update these Terms & Conditions from time to time. We will update the "last updated" date above when we do. Continued use of Globlo after changes take effect constitutes acceptance of the updated terms.
